SUBJECT:    Revised Academic Personnel Policies

The University has issued revisions to the following systemwide policies:

Academic Personnel Policy 028, Disclosure of Financial Interest in Private Sponsors of Research (effective immediately)

APM – 028 implements the requirements of the state Political Reform Act of 1974 (Government Code Section 87100 et seq.) which requires state agencies to have conflict of interest codes and to institute financial interest reporting and disclosure procedures for designated officials. The Academic Decision Regulation (California Code of Regulations Section 18702.(c)(2)) governs the applicability of the Political Reform Act to researchers; it requires them to report to campus officials the financial interests in non-governmental research sponsors, including investments, income, and gifts that may affect research decisions.

Since the last issuance of APM – 028, the requirements of the Political Reform Act and its implementing regulations have been revised through a series of technical amendments. Corresponding revisions have been made to reflect changes in the statute and regulations governing reporting of financial interests by researchers at California public universities, changes in job titles at the University of California, and non-substantive grammatical improvements. In addition, based on comments received during the systemwide review of the proposed revisions to APM 028, text was added to clarify certain terms and concepts including:

· A footnote was added to the word “investment” in Section II.A.1

· A definition of “gift” (from the Fair Political Practices Commission Form 700-U) has been added to Section II on Definitions.

· A footnote referencing Fair Political Practices Commission Form 700-U has been added to Section III, Disclosure Requirement.

Technical changes to the following Academic Personnel Policy Sections (effective June 11, 2010)

Revisions have been made to APM sections 015, Part II; 035-0, 036-0; 140-33-b; 160, Appendix A; 220-4-b; 230-20-h; and 310-17-c (representing technical changes to conform these policies to other University policies or to changes in legal definitions.)
