SUBJECT:    Proposed SPP Program Modifications

The University has developed a proposal to update the designations
of Staff Personnel Program (SPP) job titles for purposes of
administering the SPP hours of work and overtime policies to
satisfy the requirements of the federal Fair Labor Standards Act
(FLSA) as defined by recent court interpretations. A summary of
this systemwide proposal is attached for your review.

The FLSA is a law regulating employees' hours of work,
compensation, and other employment conditions. Two types of
employees are identified in the Act: hourly ("non-exempt)
employees and salaried ("exempt") employees.

   ~  Hourly employees generally are required to account for
     time worked as well as use of sick, vacation, and other
     leave time to the nearest one-quarter hour. Hourly
     employees are compensated for qualified overtime hours at
     the premium (time-and-one-half) rate.

   ~  Salaried employees are paid an established monthly or
     annual salary and are expected to fulfill the duties of
     their positions regardless of hours worked. They must
     also meet certain criteria relating to their job
     responsibilities. Exempt employees do not receive
     overtime compensation.

Recent court decisions and legal interpretations have modified the
criteria for exempt status for public employees. UC and other
employers must continually monitor changing regulatory and legal
circumstances, as well as organizational and general job market
changes, to assess their impact on the classification of employees
as exempt or nonexempt. In light of these changes, SPP policy
revisions are also proposed which distinguish clearly and precisely
between the full salaried treatment required for exempt employees
and the hourly and overtime provisions applicable to non-exempt
employees. The proposed revisions parallel those planned for
Administrative and Professional Staff (A&PS) Program policies which
have already undergone review. Following completion of this
review, it is proposed that these SPP and A&PS policy changes be
released simultaneously on an interim basis, pending final
resolution of the movement of class titles between personnel
programs.

A complete set of proposed policy revisions is being distributed to
Key Administrators within each department. A copy is also
available in the Central Library. Key Administrators are requested
to route the document or make it readily available for all affected
SPP employees to review.

Except for the changes described, all other SPP Program objectives,
policies and provisions will remain unchanged.

   PROPOSED INTERIM SPP POLICY REVISIONS FOR EXEMPT AND

             NON-EXEMPT JOB TITLES

NOTE:  Three SPP title lists are listed below:

     I--Titles that are currently designated Exempt which are
      proposed to remain Exempt.

     II--Titles that are currently designated Exempt which are
      proposed to be changed to Non-Exempt.

     III--Titles proposed for deletion at UCSD.

     All other SPP titles (nearly 800) not listed here are
     currently designated Non-Exempt, and no change is
     proposed for those titles, which are identified in the
     Title and Pay Plan.

SPP EXEMPT TITLES

Compensation Provisions Applicable to Exempt Titles

Employees in exempt SPP titles will be compensated on a salaried
basis as follows:

..  The normal work week for a full-time employee is considered to
    be 40 hours; however, greater emphasis is placed on meeting
    the responsibilities assigned to the position rather than on
    working a specified number of hours. Employees will not
    receive any overtime compensation or compensatory time off.

..  Use of vacation and sick leave and any compensatory time
   accrued prior to implementation of proposed SPP Policy
   revisions will be recorded in one-day increments; absences of
   less than a day will not be charged against accrued leave
   time.

..  When an employee has exhausted all available vacation and sick
    leave and previously accrued compensatory time off, salary
    will not be reduced ("docked") for absences of less than a
    full day. Salary may not be reduced for absences of less than
    a full day.

..  In cases of corrective action, suspensions without pay will
   not be permitted for less than one full workweek, except in
   the case of suspension for infractions of safety rules of
   major significance.

..  Exempt employees will not be required to record their work
   time or adhere to strict time recordkeeping and attendance
   rules for purposes of receiving their salary.

SPP NON-EXEMPT TITLES

Compensation Provisions Applicable to Non-Exempt Titles

..  For all hours worked over 40 in a workweek, premium overtime
   will be paid at the time-and-a-half rate. Employees may be
   compensated by time off at the time-and-a-half rate by
   agreement with the employee in accordance with the applicable
   proposed SPP interim policy section.

..  Vacation and sick leave and compensatory time use will be
   recorded to the nearest one-quarter hour.

..  When an employee has exhausted all available accrued vacation
   and sick leave and compensatory time off, salary will be
   reduced ("docked") in proportion to any absences from
   scheduled work time.

..  In cases of corrective action, suspension without pay for
   periods of less than one week will be permitted.
