SUBJECT:    Procedures for Non-Payroll Payments to Foreign Visitors with Either B-1/B-2 Visas or on a Visa Waiver Program (WB/WT)

Campus Notices were issued in September, 1996 and again in January, 1997
by Assistant Vice Chancellor Donald A. Larson announcing that the Office
of the President had issued revised procedures regarding payments to
foreign visitors.

The notices explained that the limitations applied specifically to
payments made to B-1/B-2 visa holders, as well as to visitors from
certain countries who enter under either a WB (waiver program-business
visitor) or a WT (waiver program-tourist visitor) status. The notices
also explained that this action was necessitated as a result of Executive
Order 12989, signed by President Clinton and issued February 13, 1996,
which states that employers not in compliance with this provision of the
Immigration and Naturalization Service Act may be debarred from receiving
federal contracts.

Departments hosting foreign visitors who plan to enter the United States
under either the "B" or "W" visas, should inform their visitors
immediately about these changes. In order for all campus departments to
have a better understanding of the various categories of U.S. visas and
of the procedures mandated by the Immigration and Naturalization Service
Act, the Travel Office has prepared a summary which can be accessed at:

Please note that a few sections of the summary are still in the process
of being researched and prepared; and that these sections are clearly
denoted. Due to the consequential nature of this issue, we felt that it
was important to present the summary at this time because it does clarify
the major issues and procedures.
