SUBJECT:  Proposed Revisions of UC Personnel Policies for Staff Members

This notice is provided to announce the formal review of the UC Personnel Policies for Staff Members (UCPPSM) listed below. The proposed Policy revisions result from changes recommended by a Systemwide Personnel Policy Work Group commissioned to review the effectiveness of the UCPPSM. A number of modifications are being made to simplify administration, and for consistency with collective bargaining agreements.

I. STAFF POLICY 43 - LEAVE OF ABSENCE

Section 43.C.1/Family and Medical Leave clarifies that, "An employee may be eligible for other types of leave to care for other family members, including domestic partners..." since federal law does not currently provide for use of family and medical leave for this purpose.

Section 43.G/Curtailment Leave is being added to address the curtailment of University operations for reasons that may include energy/cost savings, transitional, seasonal, or holiday periods in the academic calendar. The Policy states that, "Up to three work days of an unpaid curtailment leave shall be considered time on pay status for the purpose of accruing vacation credits and sick leave." Similar provisions are included in several of the collective bargaining agreements.

II. STAFF POLICY 60 - LAYOFF AND REDUCTION IN TIME FROM PROFESSIONAL AND SUPPORT STAFF CAREER POSITIONS

Paragraph two of Section 60.A/General introduces a Policy provision for severance pay as an alternative to preference for reemployment and right to recall, at the discretion of the campus.

Section 60.J defines Severance Pay; Subsection J.1 explains the Severance Payment Schedule, and Subsection J.2/Repayment describes related requirements when an employee who has received Severance Pay in accordance with this Policy returns to work at the same campus for a career position at the same or higher salary and same percentage of time as the position held at the time of layoff.

III. STAFF POLICY 62 - CORRECTIVE ACTION

Section 62.E/Complaints Filed Against Employees in Police Titles describes the statutory requirements for records retention for police personnel.

IV. STAFF POLICY 81 - REASONABLE ACCOMMODATION

Section 81.C/Trial Employment clarifies that the obligation to provide reasonable accommodation is not restricted to those employees who have passed their probationary periods. This Policy will provide consistency with the U.S. Equal Employment Opportunity Commission's 1999 enforcement guidance pertaining to reasonable accommodation under the Americans with Disabilities Act.
