SUBJECT:    Recruitment of Academic Personnel

I write to reaffirm that the recruitment of all academic personnel must be in compliance with University policy. This policy has been carefully constructed to ensure equal opportunity and compliance with federal and state regulations, particularly the California State Constitution as modified by Proposition 209. That portion of the constitution states in part:

The state shall not discriminate against, or grant preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting.

All employment actions, including decisions to waive the open recruitment process, must be conducted without consideration of the race, sex, color, ethnicity, or national origin of an individual.
