Subject:    New Export Compliance Certification Required for H-1B and O-1 Nonimmigrant Petitions

Effective February 20, 2011, the U. S. Citizenship and Immigration Services (USCIS) will add an export compliance certification that will affect all H-1B and O-1 petitions sponsored by the University of California, San Diego. This certification requires employers to confirm that they have reviewed the U.S. export control regulations and have determined whether or not a license is required to release controlled technology or technical data to the nonimmigrant employee.

In order to comply with the new USCIS requirement, supervisors of nonimmigrant employees must complete an "Office of Research Affairs Certification" (henceforth referred to as "the Certification,") which will be part of all future International Center's International Scholar Office H-1B and O-1 Department Request Forms: http://research.ucsd.edu/documents/I-129_ExportControl.doc

The Certification must be signed by the supervisor who has direct knowledge of the job duties of the nonimmigrant employee on whose behalf the petition is being filed. Information on export control regulations may be found at: http://ocga.ucsd.edu/Research/Export_Control/Overview.htm

If the supervisor is unable to complete the Certification, or requires more information about the export control requirements, he or she should contact the Office of Research Affairs. All future H-1B and O-1 Department Requests must include a signed Certification, which accurately attests to the information available at the time of the petition.
