On November 22, 2016, a federal judge in Texas issued a preliminary injunction that postpones the implementation of the Department of Labor's (DOL's) change to the overtime threshold from $23,660 to $47,476 under the Fair Labor Standards Act (FLSA). Many of you may be wondering whether the injunction impacts postdoctoral scholars and the December 1, 2016 salary transition. It does not. The DOL regulation on overtime was considered during contract discussions. The Postdoctoral Scholar (or PX) contract is ratified and was made effective on October 17, 2016. Consequently, all UC campuses are required to implement the contract as negotiated, including the new salary scale.
